Shanghai Maili Marine Technology Co., LTD. (hereinafter referred to as HiFleet) agrees to provide relevant services based on Internet and mobile value-added business (hereinafter referred to as Network Service) in accordance with the provisions of this Agreement and the operating rules published from time to time. In order to access the Network Service, the User of the Network Service (hereinafter referred to as User) shall agree to all the terms of this Agreement. Usage of HiFleet Network Service means that the User have fully accepts all terms of this Agreement.
2.1 HiFleet provides nautical chart, ship dynamics information, mobile value-added services, etc. The specific content of the Network Service is provided by HiFleet according to the actual condition, HiFleet reserves the right to alteration, interrupt or terminate parts or all of the Network Service.
2.2 The User acknowledges that HiFleet only provides the Network Service, the equipment related to the Network Service (such as computers, modems, mobile phones and other related devices) and the expenses (such as telephone bills and network fees for access to the Internet, etc.) shall be borne by the User.
The User must follow the following principles when using HiFleet Network Service:
(a) To observe the relevant Laws and regulations of China.
(b) The Network Service system shall not be used for any illegal purpose.
(c) Comply with all network protocols, regulations and procedures related to Network Service.
(d) Do not use the HiFleet Network Service for any behavior that may adversely affect the normal operation of the Internet.
(e) Do not use the HiFleet Network Service for any behavior that may adversely affect the safety and operation of the ports and ships.
(f) Do not use the HiFleet Network Service for any behavior against HiFleet.
(g) The account and password of the User are limited to the internal use of corporate, shall not share the account with any other corporate or natural persons.
(h) he User should immediately inform HiFleet if find any illegal use or security vulnerability of the User’s account.
(i) The User are not allowed to use HiFleet Network Service to infringe anyones patent, trademark, trade secret, copyright or other exclusive rights in any form.
4.1 The Network Service provided by HiFleet may include text, software, sound, pictures, videos, charts, etc. All such contents are protected by copyright, trademark and other property ownership laws.
4.2 The Users shall use these contents only after obtaining authorization from HiFleet or other relevant obligee, and shall not copy, reproduce, or create derivative products related to these contents without authorization.
5.1 Protecting User privacy is a basic policy of HiFleet. HiFleet guarantees that it will not disclose or provide Users registration information and non-public content stored in HiFleet while using the Network Service, except for the following situations:
(a) Obtain User’s explicit authorization in advance.
(b) According to relevant laws and regulations.
(c) In accordance with the requirements of the competent government authorities.
(d) For the purpose of protecting the public interests.
(e) For the purpose of maintain the lawful rights and interests of HiFleet.
5.2 HiFleet may cooperate with a third party to provide Users with relevant services. In such case, if the third party agrees to assume the same responsibility of protecting Users privacy as HiFleet, HiFleet can provide Users information to the third party.
5.3 Without disclosing the privacy information of individual Users, HiFleet has the right to analyze the entire User database and make commercial use of the User database.
5.4 HiFleet includes links to other websites. HiFleet are not responsible for the privacy practices of these other websites. It suggest that Users should pay attention to the privacy statements on each website that collects personally identifiable information when leaving HiFleet. This privacy statement applies only to information collected on HiFleet.
5.5 The right to modify and update the privacy policy of HiFleet belongs to HiFleet.
6.1 About the Website
(a) The copyright of articles published on HiFleet (including reposts) belongs to the original author only. If the author has a copyright notice or the articles are reproduced from other websites with a copyright notice of the original website attached, the copyright ownership shall be subject to the attached notice. HiFleet shall not be liable for any legal disputes or consequences arising therefrom.
(b) HiFleet shall not be liable for any legal disputes and consequences arising from the disclosure of User data caused by other websites linked to the HiFleet.
(c) HiFleet shall not be liable for any disclosure of User information resulting from Users sharing of the password and registered accounts with others.
(d) When government jurisdictions require HiFleet to disclose User data in accordance with legal procedures, HiFleet will provide User information at the request of law enforcement agencies or for public safety purposes. In this case, HiFleet shall not be liable for any disclosure.
(e) The User acknowledges and agrees that the use of HiFleet Network Services will be at their own risk. All consequences arising from its use of Network Services are also for its own account, and HiFleet is not liable to Users.
(f) The User acknowledges and agrees that the AIS Data provided by MarineTraffic may be inaccurate or incomplete and are subject to error, delay or change. HiFleet does not guarantee that the Network Services will meet the requirements of Users and will not be interrupted, nor does it guarantee the timeliness, safety and accuracy of the Network Services.
6.2 About the Website Operation
(a) HiFleet will announce in advance the suspension of Network Services due to system maintenance or upgrades. HiFleet shall not be liable for any inconvenience or loss caused by the suspension of Network Service due to hardware failure or other force majeure beyond the control of HiFleet.
(b) HiFleet shall not be liable for any leakage, loss, theft or alteration of User data caused by force majeure affecting the normal operation of the network such as hacker attacks, computer virus invasion or outbreak, temporary shutdown caused by government control, etc.
6.3 About the Legal liability
(a) The Users who violate the laws of the Peoples Republic of China by violating the provisions of this Statement shall be responsible for all consequences, and HiFleet shall not bear any responsibility.
(b) Any person who logs in to HiFleet in any way or uses HiFleet data directly or indirectly shall be deemed to have voluntarily accepted and be bound by the HiFleet declaration.
(c) Issues not covered by this Agreement Statement shall be referred to the relevant laws and regulations of China. In case of any conflict between this Agreement Statements and the laws and regulations, the national laws and regulations shall prevail.
6.4 About Ship information and digital chart services
All data provided on this website are not legally binding or liable, HiFleet does not assume any responsibility or make any warranty, which is for reference only.
7.1 HiFleet will notify in advance as far as possible if Network Service is to be suspended due to system maintenance or upgrade.
7.2 HiFleet have the right to interrupt or terminate the Network Service provided to the Users under this Agreement at any time without notifying Users in any of the following circumstances:
(a) The information provided by the User is not true.
(b) User violates the rules of regulation terms in this Agreement.
7.3 In addition to the circumstances in preceding terms, HiFleet also reserves the right to interrupt or terminate part or all of the Network Service at any time without prior notice to Users. HiFleet shall not be liable to Users or any third party for any loss caused by the interruption or termination.
The User acknowledges and agrees to protect and maintain the interests of HiFleet, HiFleets partners and other Users. The User and agrees to be liable for any loss caused to HiFleet or any other third party due to the Users violation of relevant laws, regulations or any provision of this Agreement.
9.1 HiFleet may modify the relevant terms and conditions of this Agreement from time to time, and HiFleet will prompt modification on the relevant page once the terms change.
9.2 The user have the right to stop using the Network Service if User do not agree with the modification made by HiFleet to the terms of service. If the user continues to use the Network Service, it is deemed that the User has accepted the modification to the terms of service.
10.1 The conclusion, execution and interpretation of this Agreement and the settlement of disputes shall be governed by the laws of the Peoples Republic of China.
10.2 In case of any dispute between the Parties on the content or execution of this Agreement, the parties shall try their best to settle it through friendly negotiation. If no agreement can be reached through negotiation, both parties agree to submit to Shanghai Arbitration Commission for arbitration and accept its arbitration rules. The arbitration award shall be final and the parties shall perform the award unconditionally.
All notifications under this Agreement can be made by way of page announcements, E-mail, SMS, or regular mail delivery. The notification shall be deemed to have been delivered to the addressee on the date of dispatch.
12.1 This Agreement constitutes the entire agreement between the Parties on the matters agreed in herein Agreement and other related matters, and no other rights are granted to the Parties hereto except as provided herein.
12.2 If any provision of this Agreement is invalid or unenforceable in whole or in part for any reason whatsoever, the remaining provisions of this Agreement shall remain valid and binding.
